Welcome to furnitureamericana.com (“Site”). By visiting or shopping here, you agree to these Terms. Please read them carefully. This agreement uses binding arbitration (not jury trials or class actions) to resolve disputes and limits certain remedies, as allowed by law.

When you email us or use the Site, you’re communicating electronically. You consent to receive notices from us by email or postings on the Site. Those communications count as “in writing.”

3) Copyright & License
Everything on the Site—text, images, software, graphics, audio/video—is protected by copyright and owned by Furniture Americana Inc. or our licensors.
We grant you a limited, nonexclusive, non-transferable license to access and make personal, noncommercial use of the Site.

What you can’t do without our written OK:

  • Download (beyond normal page caching), copy, republish, sell, publicly display, or make derivative works of Site content.
  • Use data mining, robots, or similar tools.
  • Use product listings, descriptions, pricing, or account data for third parties or commercial purposes.
  • We enforce our IP rights.

4) Trademarks
We use our own trademarks. We may also refer to other brands only to describe fitment or compatibility. That does not mean any affiliation, endorsement, or sponsorship by those brands.

5) Your Account
Keep your login confidential. You’re responsible for activity under your account. If you’re under 18, use the Site only with a parent/guardian. We may refuse service, cancel orders, or close accounts at our discretion.

6) Copyright Complaints (DMCA)
We respect IP rights. If you believe content infringes yours, follow our DMCA Notice procedure (see “Notice & Procedure” at the end).

7) Risk of Loss
Purchases ship under a shipment contract. Title and risk transfer to you when we deliver to the carrier.

8) Disclaimers & Limitation of Liability
The Site and all content/products/services are provided “AS IS” and “AS AVAILABLE.”
We make no warranties—express or implied (including merchantability or fitness for a particular purpose).
We do not guarantee the Site or emails are virus-free.
To the fullest extent allowed by law, Furniture Americana isn’t liable for direct, indirect, incidental, punitive, consequential, or other damages arising from using the Site or products/services shown or sold here. Some states don’t allow certain limitations, so parts of this section may not apply to you.

9) Disputes & Arbitration (Important)
Any dispute related to your Site use or our products/services will be resolved by binding arbitration under the Federal Arbitration Act, except you may bring qualifying claims in small claims court.
No class actions: Disputes proceed individually, not as class, consolidated, or representative actions. If a claim proceeds in court, we both waive jury trials. Either party may sue in court to protect IP rights.

10) Applicable Law
Federal arbitration law, applicable federal law, and the laws of Texas (conflict-of-laws rules excluded) govern these Terms and any disputes.

11) Order Acceptance
Your order confirmation isn’t our acceptance. We may accept or reject orders, limit quantities, or cancel for any reason. If we cancel after charging your card, we’ll issue a credit to the same card.

12) Product Display/Colors
We try to show products accurately, but screen settings vary; colors may differ in person.

13) Website Errors
Prices, availability, and info can change without notice. We correct errors where found and may revoke offers or fix inaccuracies—even after an order is placed/confirmed. If your card was charged and we cancel, we’ll credit your card (timing depends on your bank). Returns follow our Return Policy.

14) No Third-Party Beneficiaries
These Terms don’t create rights for anyone else.

15) Indemnity
You agree to indemnify and hold harmless Furniture Americana and affiliates, officers, employees, partners, and licensors from third-party claims (including reasonable attorneys’ fees) arising from your Site use, violations of these Terms, or infringement of others’ rights.

16) Links
We may link to third-party sites. We’re not responsible for their availability, content, products, or services and aren’t liable for any resulting loss or damage.

17) Shared/User-Generated Content
If you reply to our request with the specified hashtag, or post content to our sites/social channels, you grant us a worldwide, perpetual, royalty-free, transferable, irrevocable, non-exclusive license to use, modify, display, adapt, publish, sell, translate, create derivative works, distribute, and commercialize that content in any media—without additional consent or compensation. You confirm you have the rights to grant this license. We may include or omit your name/username.

18) New Product Suggestions
Please don’t send unsolicited ideas (products, designs, ads, concepts). If you do, they become Furniture Americana’s property without obligations of confidentiality or compensation, and we may use them for any purpose.

19) Site Policies; Changes; Severability
Other policies (e.g., Shipping and Returns) also apply. We may update the Site, policies, or these Terms at any time. If you continue using the Site after notice, you’re agreeing to the updated Terms. If any provision is invalid, the rest remain enforceable.

20) Termination
We may terminate accounts or Site access at any time. You’re responsible for orders/charges incurred before termination. We may change, suspend, or discontinue any Site feature without notice.

22) Notice & Procedure for Copyright Claims (DMCA)
Provide a written notice including:

  1. Your physical/electronic signature.
  2. Identification of the copyrighted work.
  3. Identification of the infringing material and its location on the Site.
  4. Your address, phone, and email.
  5. A statement of good-faith belief that the use is unauthorized.
  6. A statement, under penalty of perjury, that the notice is accurate and you’re the owner or authorized agent.
